About our privacy policy

This privacy policy applies to our websites, apps and other services, including programs and events, that refer or link to this privacy policy (each, a “Service”). This policy may be supplemented by additional privacy statements, terms or notices provided to you or by the Service.

1. Information we collect

2. How we use your information

Any processing of Users’ Personal data shall rely on the following legal grounds, that is either (i) the prior consent of the User (Geolocalisation Data, cookies and trackers, data used for promotional purposes), (ii) the provision of NIU’s Services (Identification data and vehicle data) or (iii) the legitimate interests pursued by NIU (such as preventing fraud or criminal activity, misuses of NIU’s products or services as well as the security of NIU IT systems, architecture and networks, if any data used for promotional purposes).

Users’ Personal Data will not be transmitted or made accessible to any third party, except to NIU’s authorized persons and NIU’s service providers, for the completion of the purposes listed above (such as IT systems providers, hosting providers, consultants (including lawyers, tax accountants), being stated that each of these service providers are bound by data protection and confidentiality obligations in order to protect Users’ Personal Data.

User’s Personal Data may be transferred to a country located outside your legion, currently China, being specified that, NIU undertakes to take all relevant guarantees on the basis of appropriate safeguards as requested under the Data Protection Legislation.

NIU will only retain Users’ Personal Data for as long as necessary to fulfil the purpose for which it was collected or to comply with legal or regulatory requirements.

In particular, Users’ Personal Data will be kept during the business relationship and, beyond, for promotional purposes, for reasons of proof and for accounting purposes, for a period not exceeding the applicable statutory limitation periods.

3. Our protection measures

NIU has implemented adequate technical and organizational measures to protect Users’ Personal Data against unauthorized, accidental or unlawful destruction, loss, alteration, misuse, disclosure or access and against all other unlawful forms of processing. These security measures have been implemented taking into account the state of the art of the technology, their costs of implementation, the risks presented by the processing and the nature of the personal data.

NIU undertakes that all personnel accessing Users’ Personal Data complies with the internal rules and processes in relation to the processing of personal data to protect them and ensure their confidentiality. They are also required to follow all technical and organizational security measures put in place to protect the Users’ Personal Data.

4. Storage period

NIU will only retain your personal data for as long as necessary to fulfil the purpose for which it was collected or to comply with legal or regulatory requirements. Your personal data will be kept during the business relationship and, beyond, for promotional purposes, for evidentiary and accounting purposes, for a period not exceeding the applicable statutory limitation periods.
If you have opened a user account with us, we will retain your personal data until you decide to delete your user account. We will also retain your personal data for three years from the time you last logged into your user account, during which time we may send you promotional information for products or services similar to those we offer you. At the end of this period, we consider your user account as inactive and we delete your personal data.

Finally, unless you have given us your express consent to keep your payment information in order to facilitate subsequent payments during the term of the business relationship and, in any case until your bank card expires, your payment information will be kept for a period of 13 months following the date of payment as evidence in the event of a possible dispute relating to the transaction.

5. Security

These security measures have been implemented taking into account the state of the art of the technology, their costs of implementation, the risks presented by the processing and the nature of the personal data. NIU undertakes that all personnel accessing your personal data complies with the internal rules and processes in relation to the processing of personal data to protect them and ensure their confidentiality. They are also required to follow all technical and organizational security measures put in place to protect your personal data. 6. Your rights

You have the right to access, modify, rectify, limit, delete and ask, if any, for the portability of your personal data as well as a right to object to the processing of such data. You also have the right to withdraw your consent where NIU obtained your prior consent to process personal data (this withdrawal does not affect the lawfulness of any processing that took place prior to the withdrawal). You may also define guidelines for post mortem use of your personal data. Finally, you have the right to lodge a complaint with the relevant data protection authority. This website may contain links to other third party websites that are not controlled in any way by NIU. Please be aware of this when you click on any such links; we are not responsible for the privacy practices and/or policies of any website other than our own. Consequently, we suggest that you review the privacy policy of every website you visit, whether or not they are linked to by our own site.

We may also provide visitors to our website the opportunity to opt-in to receive communications from us. In this case, we ask the user for his or her email address and name. These communications will include our regular newsletter, product promotions and any other information that we feel may be pertinent to the user.
